Acceptance of Terms

By providing your mobile phone number and opting in to the Prospekt SMS Customer Care and Appointment Reminders program, you agree to these SMS Terms and Conditions and to Prospekt’s Privacy Policy. You represent that you are the authorized user of the mobile number provided or that you are otherwise authorized to consent to receive messages at that number.

Program Description

The Prospekt SMS Customer Care and Appointment Reminders program is intended to help Prospekt communicate with leads, customers, and contacts about customer service matters and appointment-related activity. Messages may include appointment booking confirmations, reminders, rescheduling notices, follow-up communications, customer care responses, service updates, verification steps, and other information reasonably related to your relationship with Prospekt.

Where legally permitted and where the required consent has been obtained, Prospekt may also send occasional informational or promotional text messages related to services, offers, or updates. Promotional messaging will be sent only in accordance with applicable consent requirements.

You may opt in through a website form, scheduling flow, intake form, verbal process followed by documented confirmation, or another authorized method made available by Prospekt. By opting in, you consent to receive recurring automated or non-automated text messages at the mobile number you provided, to the extent permitted by law and consistent with the scope of your consent.

Your consent is not a condition of purchasing any goods or services unless expressly stated in a lawful and clearly disclosed circumstance. You are responsible for providing a valid mobile number and for updating that number if it changes.

Message Frequency

The number of messages you receive will depend on your appointments, support requests, account activity, transaction status, and the communication choices you have made with Prospekt. Some users may receive only a few messages connected to a scheduled interaction, while others may receive additional service or support texts depending on their engagement.

Message and Data Rates

Message and data rates may apply. Wireless carriers may charge fees for text messages or data usage based on your individual wireless service plan. Charges are billed and payable to your wireless carrier, and not to Prospekt.

STOP Flow and Opt-Out

To stop receiving SMS messages, reply STOP to any Prospekt text message.

After you send STOP, Prospekt may send you a final confirmation text confirming that you have been unsubscribed. After that, you should no longer receive marketing SMS messages from that program unless you opt in again. For customer care or appointment-related messages, Prospekt may still contact you through other lawful channels where necessary to complete a requested service, respond to an inquiry, or administer your account.

You may also contact info@heyprospekt.com for assistance with opting out. If your texting platform supports additional opt-out keywords such as END, CANCEL, UNSUBSCRIBE, or QUIT, Prospekt may treat those as revocations of consent where appropriate.

HELP Instructions

For help with the messaging program, reply HELP to any Prospekt SMS message or contact info@heyprospekt.com. Help responses may provide support contact information, program identification, or instructions for opting out.

Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your wireless service provider and may be affected by your carrier, network conditions, handset compatibility, service availability, geographic coverage, or other factors outside Prospekt’s control.

Privacy and Data Handling

Your use of the messaging program is also subject to the Prospekt Privacy Policy, available at https://heyprospekt.com/privacy-policy. The Privacy Policy explains how Prospekt collects, uses, discloses, and protects personal information, including information associated with messaging consent and communications.

Mobile opt-in data, SMS consent, and related phone number information are not shared with third parties or affiliates for their marketing or promotional purposes. Such information may be shared only with vendors or service providers that support delivery of the messaging program, maintain systems, provide operational assistance, or help comply with legal obligations, and only for those limited purposes.

User Responsibilities

You agree to provide accurate and complete information and to use the messaging program only for lawful purposes. You agree not to misuse the program, impersonate another person, interfere with the service, or provide a phone number for which you are not authorized to receive messages.

Changes and Availability

Prospekt may modify, suspend, or terminate the messaging program or these SMS Terms and Conditions at any time, subject to applicable law. Changes will be effective when posted to the applicable page or otherwise communicated to you, unless a different effective date is stated.

Limitation of Liability

To the maximum extent permitted by applicable law, Prospekt is not liable for delays, failures, or interruptions in message delivery caused by wireless carriers, internet providers, platform providers, device settings, force majeure events, or circumstances outside its reasonable control. Nothing in these terms excludes any rights that cannot be waived under applicable law.

Governing Standards

These SMS Terms and Conditions are intended to be administered in a manner consistent with applicable laws governing privacy, electronic communications, consumer protection, and truthful business disclosures, including privacy requirements in Canada and consumer protection expectations in New York. Any provision will be interpreted to the minimum extent necessary to remain valid and enforceable under applicable law.
